A FOREIGN murderer can stay in the UK after a judge ruled his failure to mention his criminal past was an honest mistake.
The Romanian got 20 years in his homeland in 1997 for suffocating a man of 60 with a towel before stealing cash from his flat.
Immigration Judge Luke Bulpitt said he believed the decorator, who was not named, made a genuine error in not mentioning it “in part resulting from his wish to move on from his criminal past”.
The man had come to the UK in May 2018 under EU freedom of movement laws.
In 2019 his application to remain was approved when he failed to reveal his previous convictions.
Immigration officials moved to deport him as a “serious threat” in 2022 after a police probe into an alleged attack on his wife and an affray.

The dad of two was arrested for both but not charged.
He appealed on the grounds his family life would be damaged — despite being divorced that year and left by a girlfriend whose son with him was put in care to protect him from his dad.
Judge Bulpitt granted his appeal.
He said there was no evidence the man carried out crimes in the UK, and was no threat.
